Terms of service
The terms that apply when you use synodicstudio.com. Project work is governed by a separate written agreement.
Last updated
These terms are short because the site is simple. It presents our work, describes what we do and gives you a way to contact us. Reading it commits you to very little. Sending us an enquiry commits neither of us to a project. Anything beyond that is agreed in writing, per engagement, and those agreements take precedence over this page.
01
Who we are and what these terms cover
Synodic Studio ("Synodic", "we", "us"), a studio based in Aarhus, Denmark, publishes www.synodicstudio.com (the "Site") and can be reached at contact@synodicstudio.com. These terms govern your access to and use of the Site and its content. By using the Site you accept them. If you do not agree, the remedy is simple: do not use the Site.
These terms cover www.synodicstudio.com only. SynodicAC (ac.synodicstudio.com), Synodic Store (store.synodicstudio.com) and Synodic Support (support.synodicstudio.com) each have their own terms in the tabs at the top of this page, and those terms apply when you use them. The status badge and help links on the Site simply lead to those services.
Synodic Studio is a trade name rather than a registered company, and the Site is published by the studio's founders. Nothing here should be read as a statement that a registered entity of that name exists.
The Site links to products that we build or run together with partners, including MineClub and MCCatalog. Those products are separate services. Their own terms, licences and privacy notices apply to them, and these terms do not extend to anything that happens on them.
If we take on a project for you, the engagement will be governed by a written proposal, statement of work or master services agreement. Where such a document conflicts with these terms, the written agreement wins.
02
Using the Site
You may browse the Site, read its content and get in touch with us for legitimate business purposes. In return we ask that you do not:
- use automated tools to scrape, crawl or harvest content or contact details beyond what ordinary search engine indexing does;
- attempt to probe, disrupt or gain unauthorised access to the Site, its infrastructure or any connected system;
- send us spam, marketing, malware, or anything unlawful, abusive or misleading;
- impersonate another person or company, or misrepresent who you act for;
- remove or obscure notices of ownership, or present our content as your own.
We may block or rate-limit access that breaches these rules, without notice, and may take further action where the law allows.
03
Enquiries, proposals and no obligation
Emailing us is an invitation to talk, not an order. We are not obliged to respond to every enquiry, to take on any project, or to keep any budget or timeline you mention. Equally, you are not committed to anything by asking.
Information on the Site about services, process and past results is descriptive. It is not a quotation and not a guarantee of results for your project. Prices, scope, timelines and deliverables are agreed in writing for each engagement, and only that writing is binding.
If you send us ideas, briefs or materials before an agreement is in place, you confirm that you have the right to share them. We treat them as confidential business information, but we do not accept any obligation regarding unsolicited material beyond what the law requires, and we may be working on similar things already.
04
Intellectual property
The Site and its content, including text, design, layout, graphics, photography, video, animation, code and the Synodic name and mark, are owned by Synodic or used under licence. All rights are reserved. You may view the Site and make temporary copies as a normal part of browsing, and you may quote short excerpts with attribution. You may not otherwise reproduce, distribute, adapt or commercially exploit the content without our written permission.
Case studies show work done for and with partners. The partners' names, logos, products and screenshots belong to them and appear with their permission. Nothing on the Site grants you any right to use a partner's marks or materials.
Where a case study describes technology or a technique, the description is for information. It does not license you to use any code, design or process shown, and it does not disclose the confidential terms of the underlying engagement.
05
Third-party trademarks
Some of the products described on the Site are made for games and platforms we do not own. Where we name them, we do so descriptively, to say what the work was. That naming is not a claim of any relationship with the rights holder.
In particular: we are not an official Minecraft product, and we are not approved by or associated with Mojang or Microsoft. Minecraft is a trademark of Mojang Synergies AB, and Mojang's own brand and asset guidelines govern any use of it. OptiFine, Java and every other product or company name on the Site belong to their respective owners and are used only to identify the thing they name.
Likewise, Synodic Studio is not affiliated with, endorsed or sponsored by Roblox Corporation or Discord Inc. Roblox and Discord are trademarks of their respective owners.
If you are a rights holder and something here is not right, write to us at contact@synodicstudio.com and we will correct it.
06
Links and third parties
The Site links to external websites, including partner products and social networks. We do not control those sites and are not responsible for their content, availability, security or how they handle your data. A link is not an endorsement. Following a link is your decision, and the terms of the destination apply from that point.
07
Availability and changes to the Site
We aim to keep the Site available and accurate, but we do not promise that it will be uninterrupted, error-free or up to date at every moment. We may change, suspend or remove any part of the Site at any time, including case studies and descriptions of services, without notice.
Content that reflects past work or figures describes the situation at the time it was written. We revise it periodically but do not guarantee that every statistic or statement remains current.
08
Disclaimer
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, about the Site or its content, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. Nothing on the Site is professional advice, and you should not rely on it as such for a decision about your own project without speaking with us or another qualified adviser.
09
Limitation of liability
To the extent permitted by law, Synodic will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Site. Our total liability for any claim relating to the Site, whether in contract, tort or otherwise, is limited to one hundred euros (EUR 100).
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. If you are a consumer, you keep all rights that consumer protection law gives you and that cannot be waived by agreement.
Liability under a project agreement is governed by that agreement, not by this section.
10
Personal data
How we handle personal data in connection with the Site, including when you email us, is described in our privacy policy at www.synodicstudio.com/privacy (the Synodic Studio tab). It forms part of these terms.
11
Governing law and disputes
These terms and any dispute arising from them or from the Site are governed by the laws of Denmark, without regard to its conflict of law rules. The courts of Denmark have exclusive jurisdiction, except that if you are a consumer resident in another EU or EEA country, you may also bring proceedings in your own country and benefit from its mandatory consumer protection rules.
If a dispute arises, we would ask that you write to contact@synodicstudio.com first. We prefer to sort things out directly.
12
General
If any part of these terms is found invalid or unenforceable, the rest continues in effect and the invalid part is replaced by a valid one that comes as close as possible to its intent. A failure by us to enforce a term is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between you and us about the Site. You may not assign your rights under them; we may assign ours to a successor to the business.
13
Changes to these terms
We may revise these terms from time to time. The revised version takes effect when it is published on this page, and the date at the top will change accordingly. Material changes will be flagged on this page for a period after publication. If you continue to use the Site after a revision, the revised terms apply.
